Scope of this policy<\/h2><p>This privacy policy governs <strong>the processing of personal data on the website www.orthodental.si\/en<\/strong>: visiting the site, submitting web forms, subscribing to our newsletter, and the use of cookies and similar technologies.<\/p><p>The processing of patient health records (dental chart, radiographs, digital impressions, treatment plans) takes place in a separate patient management system, Flerp Dent, and <strong>is not covered by this policy<\/strong>. Data you submit through a web form is not transferred to that system automatically; we enter it only once an appointment has been arranged. We inform you about the processing of health data at your first visit to the clinic.<\/p><h2>2. The forms are operated by SqualoMail.<\/p><p>Your enquiry is recorded in our customer relationship system (monday.com), where we keep track of contacts and appointment scheduling. That system holds <strong>only contact details and notes about the scheduling conversation<\/strong> &ndash; name, telephone number, email address, preferred location and call status. We use these to contact you, usually by telephone, to arrange a first consultation.<\/p><p>If no appointment is arranged, we may try to reach you a few more times, but <strong>we do not initiate contact for longer than 12 months<\/strong> from your enquiry.<\/p><p>The exception is a callback you ask for yourself: if you tell us during the call that you would like to decide later (for example because you are abroad, pregnant, or for other personal reasons), we record only <strong>the date on which to call you<\/strong> and contact you then, even beyond 12 months. We do not record the reason for the delay.<\/p><p>You can ask us to stop contacting you at any time &ndash; simply say so on the phone or write to info@orthodental.si. We will then delete your enquiry and all associated contact details from our system.<\/p><p>If an appointment is arranged, we manually enter your contact details into our patient management system, Flerp Dent. We justify this longer period on the basis that the decision to undergo orthodontic treatment is often deferred and people return to an earlier enquiry after several years, and by the limitation periods for potential claims. We initiate contact only during the first 12 months, unless you asked for a later callback (see above). After 5 years the record is deleted from monday.com. If you become our patient, the statutory retention periods for health records apply.<\/td><\/tr><\/table><\/div><p><strong>Are you required to provide this data?<\/strong> No. Providing personal data through a form is neither a statutory nor a contractual obligation and you may decline at any time. Without contact details we cannot reply to your enquiry or arrange an appointment; you are welcome to call us or visit in person instead.<\/p><h3>3.3 Newsletters and direct marketing<\/h3><p>If you subscribe to our newsletter or tick the consent box on a form, we send you information about our services and offers by email or SMS.<\/p><div class=\"tw\"><table><tr><th>Purpose<\/th><td>Informing you about services, offers and news<\/td><\/tr><tr><th>Legal basis<\/th><td>Article 6(1)(a) GDPR &ndash; your consent. These include an encrypted connection (HTTPS), access controls, and limiting access to staff who need the data for their work. All staff and contracted processors are bound by confidentiality.<\/p><h2>11. Changes to this policy<\/h2><p>We may update this privacy policy from time to time. Each time we do, we publish the new version on this page and update the date of last change. Obrazce izvaja ponudnik SqualoMail.<\/p><p>Oddano povpra\u0161evanje se zabele\u017ei v na\u0161 sistem za upravljanje odnosov s strankami (monday.com), kjer vodimo evidenco kontaktov in dogovarjanja o terminu. V tem sistemu hranimo <strong>izklju\u010dno kontaktne podatke in opombe o poteku dogovarjanja<\/strong> &ndash; ime, telefonsko \u0161tevilko, elektronski naslov, \u017eeleno lokacijo in status klica. Na podlagi teh podatkov vas kontaktiramo, obi\u010dajno po telefonu, in se sku\u0161amo dogovoriti za termin prvega pregleda.<\/p><p>\u010ce do dogovora ne pride, vas lahko poskusimo poklicati \u0161e nekajkrat, vendar <strong>na lastno pobudo ne vzpostavljamo stikov dlje kot 12 mesecev<\/strong> od va\u0161ega povpra\u0161evanja.<\/p><p>Izjema je dogovorjen kasnej\u0161i klic: \u010de nam ob pogovoru sami poveste, da se za pregled \u017eelite odlo\u010diti pozneje (na primer zaradi bivanja v tujini, nose\u010dnosti ali drugih osebnih okoli\u0161\u010din), si zabele\u017eimo zgolj <strong>datum, ko naj vas pokli\u010demo<\/strong>, in vas ob dogovorjenem \u010dasu kontaktiramo tudi po preteku 12 mesecev. Razloga za odlog ne bele\u017eimo.<\/p><p>Kadar koli lahko zahtevate, da vas prenehamo kontaktirati &ndash; dovolj je, da to poveste po telefonu ali nam pi\u0161ete na info@orthodental.si. Va\u0161e povpra\u0161evanje in vse pripadajo\u010de kontaktne podatke v tem primeru izbri\u0161emo iz sistema.<\/p><p>\u010ce se dogovorimo za termin, va\u0161e kontaktne podatke ro\u010dno vnesemo v sistem za vodenje pacientov Flerp Dent. Te podatke obdelujemo na podlagi to\u010dke (h) drugega odstavka 9. \u010dlena GDPR (izvajanje zdravstvenega varstva) in jih obravnavamo z enako stopnjo zaupnosti kot zdravstveno dokumentacijo.<\/td><\/tr><tr><th>Rok hrambe<\/th><td>Do 5 let od va\u0161ega povpra\u0161evanja, \u010de ne pride do obiska ordinacije. Dalj\u0161i rok utemeljujemo s tem, da je odlo\u010ditev za ortodontsko zdravljenje pogosto odlo\u017eena in se posamezniki k povpra\u0161evanju vrnejo tudi po ve\u010d letih, ter z zastaralnimi roki za morebitne zahtevke. Na lastno pobudo vas kontaktiramo le v prvih 12 mesecih, razen \u010de ste sami zaprosili za kasnej\u0161i klic (glej zgoraj). Po izteku 5 let zapis v sistemu monday.com izbri\u0161emo. \u010ce postanete na\u0161 pacient, za podatke v zdravstveni dokumentaciji veljajo zakonski roki hrambe.<\/td><\/tr><\/table><\/div><p><strong>Ali morate podatke posredovati?<\/strong> Ne. Posredovanje osebnih podatkov prek obrazca ni zakonska ali pogodbena obveznost in ga lahko kadar koli opustite. Pravna podlaga je to\u010dka (f) prvega odstavka 6. \u010dlena GDPR &ndash; zakoniti interes za za\u0161\u010dito pred zlorabami.<\/p><h3>3.6 Obrazci na dru\u017ebenih omre\u017ejih<\/h3><p>Poleg obrazcev na spletnem mestu uporabljamo tudi obrazce znotraj platform Facebook in Instagram (t. i. neposredni obrazci). \u010ce tak\u0161en obrazec izpolnite, nam platforma posreduje podatke, ki ste jih v njem navedli &ndash; ime, elektronski naslov in telefonsko \u0161tevilko. Ti podatki se zabele\u017eijo v istem sistemu (monday.com) in jih obdelujemo na enak na\u010din ter pod enakimi pogoji kot povpra\u0161evanja, oddana prek spletnega mesta. Za obdelavo podatkov znotraj same platforme je odgovoren upravljavec platforme v skladu s svojo politiko zasebnosti.<\/p><h2>4. Komu posredujemo osebne podatke<\/h2><p>Osebnih podatkov ne prodajamo. Tak\u0161ni prenosi potekajo na podlagi V. poglavja GDPR, in sicer na podlagi sklepa Evropske komisije o ustreznosti (Okvir EU-ZDA za zasebnost podatkov), kadar je prejemnik vanj vklju\u010den, ali na podlagi standardnih pogodbenih klavzul iz 46. \u010dlena GDPR, dopolnjenih z dodatnimi tehni\u010dnimi in organizacijskimi ukrepi. Kako dolgo hranimo podatke<\/h2><p>Osebne podatke hranimo le toliko \u010dasa, kolikor je potrebno za namen, za katerega so bili zbrani, oziroma toliko \u010dasa, kolikor to zahteva zakon. Konkretni roki so navedeni pri vsaki vrsti obdelave v 3. poglavju. Po izteku roka podatke izbri\u0161emo ali nepovratno anonimiziramo.<\/p><h2>7. Va\u0161e pravice<\/h2><p>V zvezi z va\u0161imi osebnimi podatki imate pravico do dostopa do podatkov in kopije, popravka neto\u010dnih in dopolnitve nepopolnih podatkov, izbrisa, omejitve obdelave, ugovora obdelavi na podlagi zakonitega interesa in kadar koli ugovora neposrednemu tr\u017eenju, prenosljivosti podatkov ter preklica privolitve.<\/p><p>Zahtevo po\u0161ljite na info@orthodental.si ali po po\u0161ti na OrthoDental d.o.o., Vilharjeva cesta 42, 1000 Ljubljana. Odgovorili vam bomo <strong>najpozneje v enem mesecu<\/strong> od prejema zahteve. Ta rok lahko podalj\u0161amo za najve\u010d dva meseca, o \u010demer vas obvestimo skupaj z razlogi. Uveljavljanje pravic je brezpla\u010dno. Zaradi za\u0161\u010dite va\u0161ih podatkov lahko pred obravnavo zahteve zahtevamo dodatna dokazila o va\u0161i istovetnosti.<\/p><h2>8. Varnost podatkov<\/h2><p>Izvajamo ustrezne tehni\u010dne in organizacijske ukrepe za za\u0161\u010dito osebnih podatkov pred nepoobla\u0161\u010denim dostopom, izgubo ali razkritjem. Med drugim uporabljamo \u0161ifrirano povezavo (HTTPS), nadzor dostopa in omejevanje dostopa na zaposlene, ki podatke potrebujejo za svoje delo.
